I am a Canadian Citizen looking to recruit business for my web design company in Toronto in the US. I am wondering whether I can drum up business for myself under the B1 Visa Permit. My exclusive intention would be to negotiate US contracts for my company. I have a couple of questions.
1)If I in fact using the correct Visa, how long can I theoretically stay in the US?
2)Can I legally design company websites while in the US as technically I would be working for and being paid by my Canadian company, however would my being in the US not allow me to work on sites?
3)Am I on the right track visa wise, or is there a better visa to apply for in pursuit of my getting US customers.
Obtaining B1 Visa for Canadian Citizen with Web Design Company?
What you are thinking about is very similar to what happened in the famous case called Matter of Neill. In that case, the Canadian applicant was a professional engineer who sought admission to the United States as a visitor for business under Section 101(a)(15)(b) of the Immigration and Nationality Act.
"The applicant is a principal in a firm which employs 55 people and earns about 30 per cent of its income from business in the United States during which he spends some time soliciting business; however the bulk of his time appears to be devoted to consulting with clients and obtaining necessary information from them. Since only a small amount of his time is spent soliciting business and the majority of his time appears to be spent in connection with the rendition of his professional services as an engineer, he is in effect extending his professional engineering practice to the United States.
