If I know for sure someone owns a trade mark on a name and I buy a domain name with the same exact name (for example) "cocacola.com" can I get into trouble for buying the name?

Absolutely not! you will not be in trouble, there is no law governing this. If a company failes to update their info or failes to renew its license to the domain name, than it can be owned by anyone. It would be their fault for not renewing the name. But you would rarely find big companies failing to renew the domain names....they own that name for life and they don't need to worry about renewing their domain name. Small businesses could be different. But like cocacola, pepsi, microsoft, nike, bmw and others are way too smart to let those names be available to general public.

Yes you can get into trouble. the rules are pretty lax whereas a .com rego is concerned but in .com.au regos the laws are strict and you may be sued for infringement of the trademark.

Doing so is asking for trouble in my opinion. Don't be suprised if you hear from the trademark owner once you start using the domain.
